Use of this site constitutes your acceptance of these terms and conditions which take effect on the date which you first use this site. The Authors reserve the right to change these terms and conditions at any time by posting changes online. It is your responsibility to review regularly information posted online to obtain timely notice of any such changes. Your continued use of this site after changes are posted constitutes your acceptance of this agreement as modified by the posted changes.

 

If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining Terms and Conditions shall survive, remain in full force and effect and continue to be binding and enforceable.

 

These Terms and Conditions shall be governed by and construed in accordance with the laws of England. Disputes arising herefrom shall be exclusively subject to the jurisdiction of the courts of England.

 

If these Terms and Conditions are not accepted in full, the use of this site must be terminated immediately.

 

Terms and Conditions of Purchase

 

  1. PLACING AN ORDER

1.1 Browse our website and add your chosen products to your basket

1.2 Check all items are correct.

1.3 Proceed to Checkout.

1.4 Complete Customer and Billing Information as directed.

1.5 Complete Payment Process (via our payment processing provider, Opayo).

 

  1. PROCESSING OF ORDERS

2.1 Credit and Debit cards are debited on the day you submit your Order to us.

2.2 We aim to deliver all Standard Delivery orders within 3-5 working days from receipt of your order and Next Working Day Delivery orders on the next working day if received by 12.00 noon on a working day. Next Day Delivery orders received after 12 noon will be sent out on the next working day. For the terms of this agreement orders are despatched Monday – Friday excepting Bank Holidays.

2.3 If circumstances determine that we are unable to meet this delivery aim we will notify you via the e-mail address supplied on your submitted Order.

 

  1. RIGHT TO CANCEL

3.1 By law, customers within the UK have the right to cancel their order within 14 days of the day after the date the item is delivered. This is know as a ‘Cooling Off Period’.

3.2 When returning goods under this 14 day Cooling Off Period you must tell us in writing that you wish to cancel the order (as per our Returns Policy below). This written confirmation can only be accepted by us in the form of a letter, fax or e-mail, phone calls will not be accepted as confirmation of cancellation.

3.3 This confirmation must be advised to us within 14 days from the day after the item is delivered. Any cancellations confirmed after this date will not be accepted.

3.4 Refunds for Cancelled Orders will be made as soon as possible but no later than 30 days after we have been advised by you of your decision to cancel and/or 14 days after receipt of the returned goods.

3.5 All cancelled goods must be returned within 14 days of notifying us of your wish to cancel, complete with the original confirmation slip, Return Reference (as detailed in point 4.4 of our Returns Policy) and at your own cost, to our registered address.

3.6 You have a Statutory Duty to take reasonable care of those items that constitute the cancelled order. Such items must be returned to us in the same condition as when they were received.

3.7 Items ordered specifically for a customer or made/cut to order cannot be exchanged or refunded, this includes our range of hand painted ‘Artisan’ sofa feet and legs.

3.8 In instances where we believe that reasonable care has not been taken of returned cancelled goods we may, at our discretion, make a claim for breach of this Statutory Duty.

 

  1. RETURNS POLICY

4.1 You must notify us of your intention to return an item by emailing us at [email protected]. You must notify us of your order number, the item you wish to return and the reason for the return.

4.2 We will then provide you with a ‘Returns Reference’ by email. Please ensure that this reference is included with the returned items, ideally by including a copy of this email with your parcel.

4.3 Returns received without this ‘Returns Reference’ may result in a delay to any refund being processed.

4.4 Items ordered specifically for a customer or made/cut to order cannot be exchanged or refunded, this includes our range of hand painted ‘Artisan’ sofa feet and legs.

4.5 Return carriage costs incurred by you will not be refunded unless the items are faulty.

4.6 Your statutory rights remain un-affected.

 

5. FAULTY GOODS

5.1 In the case of faulty items we shall be entitled to replace or repair faulty goods free of charge or at our sole discretion to provide a refund, as applicable.

5.2 You must notify us (in accordance with our Returns Policy above) of the issue within 30 days of receipt of the goods, providing full details of the fault.

 

6. REFUNDS

6.1 Where you have cancelled your order under the 14-day cooling off period or we have accepted goods were faulty (and not provided an exchange or repair) we will provide a refund within 14 days of receipt of the goods at our premises.

6.2 All refunds will be paid back onto the payment card used on your original order.

 

7. PRICING & AVAILABILITY

7.1 We list availability information for our products on the website, beyond what we say on our website we cannot be more specific about availability.

7.2 Delivery aims are not guaranteed and should not be relied upon as such. As we process your order we will inform you by e-mail if any products you order turn out to be unavailable.

7.3 The price of the Goods/Postage shall be the price quoted by us on our website, unless agreed otherwise by us in writing.

7.4 All prices shown on the site are exclusive of value added tax. Details of any applicable value added tax will be shown in the basket as part of the ordering process.

 

8. EVENTS BEYOND OUR RESONABLE CONTROL

8.1 We shall not be liable to you or be deemed to be in breach of the agreement by reason of any delay in performing or any failure to perform any of our obligations if the delay was due to any cause beyond our reasonable control.

8.2 Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond our reasonable control:

  • Act of God, explosion, flood, tempest, fire or accident
  • War or threat of war, sabotage, insurrection, civil disturbance or requisition
  • Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority
  • Import or export regulations or embargoes
  • Strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of ours or of a third party)
  • Power failure or breakdown in machinery

 

9. RISK & PROPERTY

9.1 Risk of damage to or loss of your chosen products shall pass to you upon receipt of your order.

9.2 Notwithstanding delivery and the passing of risk in your chosen items or any other provision of this agreement, property of your chosen items shall not pass to you until we receive cleared funds payment in full of the price of your chosen items.

 

10. PRIVACY

10.1 The privacy of your details supplied to us during the ordering process is very important to us; please review our Privacy Policy for further details.

 

11. EXPORT ORDERS

11.1 Shipments to destinations outside of mainland UK may be liable to local customs duties and taxes. It is the responsibility of the buyer to pay any charges and taxes due and you will be contacted by the courier to clear any such payments. Heico-Direct accept no responsibility for these costs and they are not included within the price of your order.

11.2 All orders received on the site from outside the UK will be sent an email confirming that the buyer is liable for the above stated costs in point 11.1.  The buyer is offered the opportunity to cancel their order if they are not accepting of responsibility for these local charges.  In such cases a full refund will be provided as long as the order has not already been dispatched.

11.3 Non UK customers from specified EU countries (see list of countries on our Delivery page) can place orders directly on this site.  If a valid EU VAT number is entered during the checkout process the site will NOT charge VAT at the standard UK rate.  If a valid EU VAT number is not entered the buyer will be charged VAT at the standard UK rate, as per UK law. This process does not effect the buyers responsibility for local duties and taxes as stated in point 11.1 above.
